SWEEPSTAKES RULES (the “Rules”)

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.


1. Eligibility: Sweepstakes (the "Sweepstakes") is open only to those who sign up at the online sweepstakes page and who are at least 18+ years old at the time of entry and who are legal residents of the United States and is void where prohibited by law. Employees of M&R Diamond Quilting Co., Inc. dba Shovlin Mattress Factory (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.



2. Agreement to Rules: By participating in the Sweepstakes, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.



3. Sweepstakes Entry Period: Entries will be accepted online starting on or about May 4th, 2023 at 9:00 AM and all entries must be received by May 11th, 2023 at 9:00 AM. All times are Eastern Standard Time (US). The deadline for receipt includes receipt of any entry envelopes pursuant to Section 4 below.



4. How to Enter: The Sweepstakes must be entered by: (1) following @ShovlinMattress on Instagram® (see https://www.instagram.com/shovlinmattress/) or on Facebook® at Shovlin Mattress Factory (see https://www.facebook.com/ShovlinMattress) and tag who you want to take a trip to Woodloch in the comments, or (2) send a plain 3”x5” piece of paper with your full name and e-mail address typed or clearly written by hand, and mail it in a sealed, properly stamped envelope and mail it to M&R Diamond Quilting Co., Inc. dba Shovlin Mattress Factory 35 South Avenue, Fanwood, New Jersey 07023 (USA), ATTENTION: SWEEPSTAKES; or (3) send a plain 3”x5” piece of paper with your full name and home address typed or clearly written by hand, and mail it together with a self-addressed, stamped return mail envelope, in a sealed, properly stamped envelope and mail it to M&R Diamond Quilting Co., Inc. dba Shovlin Mattress Factory, 35 South Avenue, Fanwood, New Jersey 07023 (USA), ATTENTION: SWEEPSTAKES.



No photocopied, computer-generated facsimiles, mechanically reproduced, or mass entries are permitted, and all such entries will be void. All automated entries will be void. All entries, whether valid or not, once received by Sponsor shall become the property of Sponsor and shall not be returned.



Sponsor shall not be responsible for lost, incomplete, illegible, late, garbled, inaccurate, misdirected, stolen, undelivered, delayed, deleted, damaged, postage-due, entries or mail; nor shall Sponsor be responsible for any online or e-mail entries which fail due to any error, omission, interruption in service, repairs, modifications, mechanical or computer problems, electronic problems, phone or transmission line problems, third-party problems or issues with Instagram® or any posting on Instagram®, interrupted or unavailable network, server or ISP or other connections, or any other causes which are not caused by Sponsor.



For an entry to be eligible to win a prize, the entrant must fulfill all Sweepstakes requirements, as specified herein. Entries or entrants that/who do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter only once (1x) as specified herein, and upon request for verification, you must provide complete and accurate information as requested. You may not enter more than once (1x) by using multiple e-mail addresses, Instagram® names, identities or devices in an attempt to circumvent the rules. Violation of any of these Rules may void your entry at the discretion of Sponsor. Sponsor makes no representations or warranties about your ability to enter or any technical or computer problems or issues, including those with Instagram® which have any impact on your ability or inability to enter the Sweepstakes, nor shall Sponsor have any liability for the failure, for any reason whatsoever, of Sponsor to receive or view your entry.



5. Prizes: The approximate retail value of all prizes is $2,000.00 (US). The sole prize is one (1) $2,000.00 (US) Gift Certificate to one of the following Woodloch Resorts: Pines, Springs or the Lodge. You are not guaranteed to win a prize and your chance of winning is dependent on the total number of eligible entries received. If you do not use the entire Gift Certificate at once, a residual gift certificate will be issued for the balance of the amount not used. However, the Gift Certificate, and any residual gift certificates, will expire two (2) years from the date of issuance of the original Gift Certificate. Winner must choose one (1) of the Woodloch Resorts for the issuance of the Gift Certificate, and once that Gift Certificate is issued, it may not be used at other Woodloch Resorts. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is nontransferable, nor shall any winner be permitted to redeem or substitute any part of any prize for cash.



Winner (and any guests) are responsible for obtaining any necessary travel documents. Winner is responsible for any and all prize-related expenses, including without limitation any and all federal, state, and local taxes or expenses incurred at or in connection with the receipt and/or use of the Gift Certificate. Winner is responsible for any expenses above the Gift Certificate amount at the Woodloch Resorts as well as any purchases at or through the Woodloch Resorts which may be excluded from the Gift Certificate, such as third-party expenses, gratuities, etc. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Sponsor to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.



6. Odds: The odds of winning depend on the number of eligible entries received.



7. Winner Selection and Notification: Winners of the Sweepstakes will be selected on or about May 11, 9:00 AM EST in a random drawing under the supervision of the Sponsor. The winner will be notified via either their Instagram® account or via e-mail to the e-mail address they entered the Sweepstakes with within five (5) days following the winner selection. Sponsor shall have no liability for a winner's failure to receive notices due to winner’s spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. Winner must, within fifteen (15) days of the date such notice is sent by Sponsor, respond to Sponsor as directed to claim the prize, including by completing and returning the provided declaration of eligibility and release of liability against Sponsor and its designees. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within said fifteen (15) period in accordance with all applicable rules and requirements, winner may be deemed to have forfeited the prize and an alternate winner selected. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.



8. Rights Granted by You: By entering this Sweepstakes you understand that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s agents, licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation, except to the extent prohibited by applicable law.



9. Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes, including in the event Instagram® takes an action affecting the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules.



Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to; multiple (more than 1) entry from the same user from different IP addresses; multiple (more than 1) entry from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.



By entering the Sweepstakes, if you provide your email address, you agree to receive email newsletters periodically from Sponsor. You can opt-out of receiving such newsletters at any time by clicking the unsubscribe link in the newsletter.



10. Limitation of Liability: By entering the Sweepstakes, you (individually and on behalf of all of your successors, assigns and heirs) shall release and hold harmless to the fullest extent permitted by law Sponsor, Instagram® and Woodloch Resorts, and their respective owners, officers, directors, employees, agents, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, successors, and assigns, from any liability, illness, injury, death, loss, litigation, claim, cost, expense or damage of any kind whatsoever that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) the purchase, possession, use or misuse of any product or item obtained through redemption of a prize; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process; (vi) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries. EXCEPT AS EXPRESSLY SET FORTH HEREIN, NO WARRANTIES OR REPRESENTATIONS ARE MADE CONCERNING THE SWEEPSTAKES, AND SPONSOR HEREBY DISCLAIMS ANY AND ALL WARRANTIES WHATSOEVER (WHETHER EXPRESS OR IMPLIED), INCLUDING , BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A SPECIFIC PURPOSE. UNDER NO CIRCUMSTANCES SHALL SPONSOR BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES. By participating in the Sweepstakes, you agree to the terms and conditions contained herein, and release Sponsor, Instagram® and Woodloch Resorts, and their respective officers, directors, and employees, from any such liability, damages, costs or expenses associated with participating in the Sweepstakes.



11. Declaration of Eligibility and Other Documents: To claim the prize, winner must execute and return to Sponsor a sworn Declaration of Eligibility confirming that winner is eligible to participate in and win this Sweepstakes and has complied with all rules set forth herein, as well as any other documents reasonably required by Sponsor to confirm compliance with these Sweepstakes rules.



12. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF UNITED STATES AND NEW JERSEY, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you agree that any and all disputes which cannot be amicably resolved between the parties, and all causes of action arising out of or connected with this Sweepstakes or your actual or attempted participation there, shall be resolved individually, without resort to any form of class action, EXCLUSIVELY BEFORE THE STATE AND FEDERAL COURTS LOCATED IN THE STATE OF NEW JERSEY. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., out-of-pocket costs, if any, actually incurred by you directly associated with entering this Sweepstakes), and you further waives all rights to have damages multiplied or increased.



13. Privacy Policy Applicability: All information submitted by or on behalf of your with an entry is subject to the Privacy Policy stated on the Shovlin Mattress Factory Website: https://www.shovlinmattress.com/privacy-policy.



14. Winner’s Identity: For the names of the winner, please contact us at info@shovlinmattress.com and in the subject line of the email type “PLEASE E-MAIL ME THE WINNER’S NAME FOR THE SHOVLIN SWEEPSTAKES.”



15. Sponsor: The Sponsor of the Sweepstakes is M&R Diamond Quilting Co., Inc. dba Shovlin Mattress Factory 35 South Avenue, Fanwood, New Jersey 07023 (USA).



16. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram®, Facebook®, LinkedIn® or Google®. You understand that you are providing your information to the Sponsor of this Sweepstakes and not to Instagram®, Facebook®, LinkedIn® or Google®.
